However, the lawyer of Dua Zahra's father Altaf Hussain Khoso does not agree with the opinion of Rai Ahmed Kharal.

Prominent lawyer Gibran Nasir Advocate is also of the opinion that the trial should be held. In this, the police may apply for dismissal of the case as a result of their investigation, on which the court will not have to agree. It will take a long time for the case to be decided as a result of the trial. There are still a variety of options in this case. Apart from the appeal in the Supreme Court, there is an option of review in the Sindh High Court.

3: Controversy over age and judicial traditions

Advocate Gibran Nasir says that in the recent past, he has fought three different cases in which a division bench of the Sindh High Court, after appearing in court for girls under the age of 18, to whom the marriage was claimed. He refused to go along.

Gibran Nasir Advocate says that there is a tradition in the High Courts that in a similar case, if the decision of the Divisional Bench is taken then the decision is taken into consideration and if the Divisional Bench deems that there is no reversal in the decision of the previous Divisional Bench. If change is necessary, then the case is referred back to the Chief Justice of the High Court. The Chief Justice constitutes a larger bench.

Gibran Nasir Advocate said that with regard to determining the age, there is a decision of the single bench of the High Court that if the age has been registered in the official documents and NADRA long before the incident, then it will be accepted. In this, government documents and papers of NADRA etc. will be given priority over medical examination.

Thus, there is a decision of the Supreme Court that in determining the age, not only the statement of the girl child will be sufficient but also the documents in this regard will be collected.

According to Gibran Nasir Advocate, in my experience, girls are usually given a fair chance to think and understand.

"When it is said that this has been done by trickery, deceit or greed, it takes a reasonable amount of time to make a better decision. During this time they are kept in government-sponsored shelter homes.
